Offpath points you at remote and outdoor places: cliffs, caves, beaches, swimming holes, off-road tracks, unmarked trails. Conditions at those places change with the weather, the season and the year, and a spot that is safe one month can kill you the next.
A pin on a map is not a guide, a permit, a forecast or a safety assessment. You go at your own risk, and you are responsible for your own judgment. Section 7 sets this out in full.
These terms are a contract between you and Offpath, the operator of the Offpath app and offpath.app. By creating an account or using the app or the website you agree to them. If you do not agree, do not use Offpath.
Our Privacy Policy explains how we handle your data and forms part of these terms.
You must be at least 13 years old, or at least 16 if you are in the European Economic Area or the United Kingdom. By using Offpath you confirm you meet that age requirement and that you are not barred from using the service under the laws of your country.
Contributor access is granted on request and at our discretion. If you add a spot, you keep ownership of what you wrote and the photos you took.
By submitting a spot you grant Offpath a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, publish and distribute that content in the app, on offpath.app, and in map embeds on other websites, for as long as the spot remains published. This licence exists only so we can show your contribution to other travellers. We do not use it to sell your photos or license them onward.
Every spot you add is credited to your username as “Found by @username”. If you choose, you can attach one link to that credit from Settings: your Instagram, TikTok or YouTube account, or a website. The link must lead to an account, channel or site that is genuinely yours. It must not impersonate anyone, mislead people about where it goes, or lead to content that is illegal, sexually explicit, malicious or spam. We may remove a link or a credit that breaks these rules, and where we substantially rewrite a spot we may credit it to Offpath instead.

A contributor's spots are reviewed by us before they go live until one of them has been approved. After that, spots they add are published straight away and are not reviewed first, so from then on moderation is reactive: anyone can report a spot from inside the app, and we may edit, unpublish or delete any spot, revoke contributor access, or suspend an account, at our discretion and without notice, where we believe these rules have been broken or where a listing puts people or places at risk. We are not obliged to monitor content, and we do not promise to review every report within any particular time.
This is the most important section of these terms.
Offpath lists places that are often remote, unmarked, unsupervised and unmaintained. There is no lifeguard, no ranger, no railing and frequently no phone signal. Sea conditions, river levels, rockfall, tides, snow, heat, wildlife and access rights all change, and our data does not change with them.
You agree that:
To the maximum extent the law allows, Offpath is not liable for injury, death, loss, fines, prosecution or damage arising from visiting or attempting to visit any place listed in the app.
Spots come from our own travels and from other users. They may be incomplete, out of date or simply wrong. Access may be seasonal, ticketed, permit-only, temporarily closed, or across land that has changed hands since the spot was added. We make no promise that any listing is current or correct.
Offpath exists because these places are not overrun, and that only stays true if the people who find them behave well. Take your rubbish out, stay on established paths, keep away from wildlife and nesting sites, observe closures, and respect the people who live nearby. If a place is clearly being harmed by visitors, tell us and we will consider removing it.
Offpath is built on Mapbox, Supabase, Expo and Apple. Your use of the app also involves those services and their own terms. We are not responsible for their availability, their content, or anything they do.
Links that contributors attach to their credit lead to accounts and websites we do not control, and we are not responsible for what they contain.
The Offpath name, logo, design, written descriptions, curated spot database and software are ours and are protected by copyright and trade mark law. Using the app does not give you any right to copy, redistribute or build on them, beyond ordinary personal use of the app itself.
Notifications are optional. The weekly reminder is scheduled on your device, and the Weekly nudge switch in Settings turns it off until you turn it back on. We may also send push notifications, for example when new spots are added to the map, and that switch does not control those. To stop every notification, turn them off for Offpath in your device settings.
You can delete your account at any time from inside the app, and you do not need our permission or our involvement to do it. We may suspend or terminate your account if you break these terms or if we stop operating the service. Sections 4, 7, 8, 11, 14, 15 and 16 survive termination.
Offpath is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the service will be uninterrupted, error free, or that any spot listing is accurate, safe or lawful to visit.
To the maximum extent permitted by law, Offpath and anyone operating it will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or lost opportunity, arising out of your use of the service.
Our total liability for any claim relating to Offpath is limited to fifty US dollars, or the amount you paid us in the twelve months before the claim, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for death or personal injury caused by negligence, for fraud, or for other liabilities that cannot lawfully be excluded. Nothing here excludes those, and in those jurisdictions the limits above apply only as far as the law allows.
You agree to indemnify Offpath against claims, losses and reasonable legal costs arising from content you submit, from your breach of these terms, or from your violation of anyone else's rights.
We may update these terms. The date at the top of the page shows when they last changed, and material changes will be announced in the app before they take effect. Continuing to use Offpath after a change means you accept the new terms.
These terms are governed by the laws of the State of New York, USA, without regard to its conflict of law rules. You and Offpath agree to the exclusive jurisdiction of the state and federal courts located in New York for any dispute, except that either party may seek injunctive relief in any court of competent jurisdiction. If you are a consumer resident in the EEA or the UK, this does not deprive you of the protection of the mandatory consumer law of the country where you live.
If any part of these terms is found unenforceable, the rest stays in force.
